LIABILITY WAIVER AND RELEASE FORM

Dink Indoor Pickleball Facility

This Liability Waiver and Release Form (the "Agreement") is entered into by the undersigned participant ("Participant") and [Dink Pickleball Ltd] ("Facility"). By signing this Agreement, the Participant acknowledges and agrees to the following terms:

1. Assumption of Risk Participant acknowledges that participation in pickleball and related activities involves inherent risks, including but not limited to bodily injury, falls, collisions, and potential exposure to communicable diseases. Participant voluntarily assumes all risks associated with participation in activities at the Facility.

2. Release of Liability Participant, on behalf of themselves, their heirs, assigns, and legal representatives, hereby releases, discharges, and holds harmless [Dink Pickleball Ltd], its owners, employees, agents, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of or related to participation in activities at the Facility, including injuries, damages, or losses caused by the negligence of the Facility or third parties.

3. Indemnification Participant agrees to indemnify and hold harmless the Facility from any claims, demands, or legal actions brought by third parties due to Participant’s actions or omissions while at the Facility.

4. Medical Treatment Authorization In the event of an injury, Participant authorizes the Facility to obtain emergency medical treatment on their behalf. Participant acknowledges that they are responsible for any medical costs incurred as a result of their participation in activities at the Facility.

5. Compliance with Facility Rules Participant agrees to abide by all rules and regulations of the Facility, including safety guidelines and conduct policies. The Facility reserves the right to remove any Participant who fails to comply with these rules.

6. Photography & Media Release Participant grants the Facility permission to use photographs or video recordings taken during activities for promotional purposes without compensation.

7. Acknowledgment of Understanding Participant acknowledges that they have read this Agreement, fully understand its terms, and sign it voluntarily. Participant understands that by signing this Agreement, they waive certain legal rights.
